Protection of Personal Information Act (POPIA)

RAF Claim Tracker ("we," "our," or "us") collects and processes your personal information in accordance with the Protection of Personal Information Act, 2013 (Act No. 4 of 2013).
1. Information We Collect
We collect the following personal information:
- Personal Identifiers: ID number, passport number, full name, date of birth
- Contact Information: Email address, cell number, residential address
- Claim Details: AR number, accident details, police station information
- Documents: Copies of ID, AR forms, medical records (as uploaded by you)
2. Purpose of Processing
We process your personal information for the following purposes:
- To act as your authorized representative in inquiring about your RAF claim
- To contact the Road Accident Fund on your behalf
- To provide you with monthly updates on your claim status
- To manage your subscription and payment
- To comply with legal obligations
3. Legal Basis
We process your personal information based on your explicit consent, which you provide by accepting these terms. You have the right to withdraw consent at any time.
4. Data Security
We implement appropriate technical and organizational measures to protect your personal information:
- All data is encrypted in transit and at rest
- Access to personal information is restricted to authorized personnel only
- Regular security audits and updates
- Secure cloud storage with backup systems
5. Data Sharing
We may share your personal information with:
- Road Accident Fund: To inquire about your claim on your behalf
- Service Providers: Payment processors, SMS providers (under strict confidentiality agreements)
- Legal Authorities: When required by law or to protect our rights
We will NEVER sell your personal information to third parties.

Under POPIA, you have the right to:
- Access: Request a copy of your personal information

- Deletion: Request deletion of your personal information

7. Data Retention
We retain your personal information for as long as you maintain an active subscription, plus 7 years thereafter for legal and accounting purposes. You may request deletion at any time.

We use essential cookies for authentication and session management. We do not use tracking cookies or third-party analytics without your explicit consent.

Legal Authorization & Consent Agreement
×Authorization to Act as Representative
I, [Your Name], ID Number [Your ID Number], hereby authorize and appoint RAF Claim Tracker (Pty) Ltd ("the Agent") to act as my authorized representative in all matters relating to my Road Accident Fund claim.
1. Scope of Authorization
I authorize the Agent to:
- Contact the Road Accident Fund (RAF) on my behalf regarding my claim
- Request updates, information, and documentation related to my claim
- Inquire about the status, progress, and requirements of my claim
- Receive correspondence and communications from RAF regarding my claim
- Act as my liaison between myself and RAF for claim-related matters
2. Limitations of Authorization
This authorization does NOT permit the Agent to:
- Make decisions on my behalf regarding settlement amounts or claim resolution
- Sign legal documents or agreements on my behalf without express written consent
- Access or manage any financial accounts in my name
- Represent me in legal proceedings without separate legal representation agreement
- Make medical decisions on my behalf
3. Authorization to RAF
I hereby authorize the Road Accident Fund to:
- Disclose claim status, progress, and requirements to the Agent
- Communicate with the Agent regarding my claim
- Provide the Agent with non-sensitive claim-related information
- Accept inquiries from the Agent as if made directly by myself
4. Identification and Verification
I understand that RAF Claim Tracker will use the following information to verify my identity when making inquiries:
- Full Name as per ID Document
- South African ID Number or Passport Number
- AR Number (Accident Report Number)
- Case Number (if applicable)
- Date of Accident
5. Duration of Authorization
This authorization shall remain in effect:
- While my subscription to RAF Claim Tracker remains active and in good standing
- Until my RAF claim is fully settled and paid, or
- Until I revoke this authorization in writing
6. Revocation of Authorization
I understand that I may revoke this authorization at any time by:
- Sending written notice to privacy@raftracker.co.za
- Cancelling my subscription through my account dashboard
- Submitting a revocation request via registered mail
Upon revocation, RAF Claim Tracker will cease all inquiries on my behalf within 48 hours and notify RAF of the revocation.
7. Fees and Costs
I understand that:
- There is a monthly subscription fee of R50 for this service
- This authorization does not constitute a contingency fee agreement
- RAF Claim Tracker will not deduct any fees from my claim payment
- All fees are subscription-based only
8. Confidentiality
RAF Claim Tracker agrees to:
- Maintain confidentiality of all claim-related information
- Use information only for the purpose of tracking my claim
- Not disclose my information to unauthorized third parties
- Comply with POPIA and all applicable data protection laws
9. No Legal Representation
IMPORTANT: I understand that RAF Claim Tracker is NOT providing legal representation. This is an administrative service only. If I require legal representation for my claim, I should consult with a qualified attorney.
10. No Guarantee of Outcome
I understand that:
- RAF Claim Tracker cannot influence RAF's decision on my claim
- The service provides information and updates only
- No guarantee is made regarding claim approval or payment timelines
- RAF's decisions are independent and final
11. Liability
RAF Claim Tracker's liability is limited to:
- Providing accurate information as received from RAF
- Making reasonable efforts to obtain claim updates
- Notifying me of any changes or requirements communicated by RAF
RAF Claim Tracker is not liable for:
- Delays caused by RAF or other third parties
- Rejection or denial of my claim by RAF
- Changes in RAF policies or procedures
- Any direct or indirect losses related to my claim
12. Acknowledgment and Consent
By accepting this authorization, I acknowledge that:
- I have read and understood this entire agreement
- I am legally authorized to provide this consent
- All information I have provided is accurate and truthful
- I grant this authorization freely and voluntarily
- I understand my rights and the limitations of this service
13. Governing Law
This agreement shall be governed by the laws of the Republic of South Africa.
